Bonfire Pit Rentals – Terms of Service

DBA of Sdchecklist LLC

1. Legal Entity Notice

Bonfire Pit Rentals is a doing business as (DBA) name of Sdchecklist LLC, a California Limited Liability Company. All services, communications, payments, and legal responsibilities are held under Sdchecklist LLC.

2. Service Overview

Bonfire Pit Rentals provides fully equipped, hassle-free beach bonfire setups, including fire pits, tiki torches, chairs, tables, lighting, games, and other outdoor leisure equipment. By booking our service, you agree to all terms herein and confirm that the Booking Party is at least 18 years old.

3. Customer Responsibilities

By booking, the customer agrees that:

-They are solely responsible for ensuring their event complies with all city, state, and beach regulations, including curfews, fire laws, alcohol restrictions, and required permits.

-Bonfire Pit Rentals is a third-party setup service only and is not responsible for any citations, fines, or shutdowns issued by local authorities for noncompliance.

-The Booking Party accepts full responsibility for the actions and safety of their guests during the rental.

Customer Availability

Customers are responsible for being available by phone on the day of the event if assistance is needed locating the setup or coordinating a requested meeting location. Bonfire Pit Rentals is not responsible for delays resulting from a customer's inability to provide an accurate location or respond to communications.

4. Reservation Authorization & Payment Agreement

By completing a reservation, the customer authorizes Bonfire Pit Rentals (DBA of Sdchecklist LLC) to charge the payment method on file for:

-Any approved add-ons, upgrades, extensions, or reservation changes requested by the customer.

-Applicable location surcharge fees, or other service fees associated with the Reservation.

-Missing, stolen, damaged, excessively dirty, or unreturned equipment.

-Additional cleanup or repair costs resulting from misuse or negligence.

-Any unpaid balance remaining after the reservation.

The customer agrees these charges may be processed without obtaining an additional signature after the service has been booked.

5. Reservation Policy, Final Details & Confirmation

Reservation Details are sent before event date to verify and confirm all final reservation details before scheduled date. This is the customer's opportunity to review and request any final changes, including:

-Setup location & special instructions

-Event start and end time

-Equipment add-ons or exchanges

-Other reservation details

Reservation details become final at 12:00 AM on the reservation date. Same-day changes to the reservation location, event time, duration, equipment, add-ons, or other reservation details are not permitted.

By proceeding with the reservation, the customer acknowledges they have reviewed and agree to our Reservation Policy, including:

-Setup locations are approximate and subject to availability.

-Exact locations cannot be guaranteed.

-Our team may arrive several hours before the reservation.

-Same-day reservation changes are not permitted.

-Once setup photos and the final pin location have been sent, the reservation is considered delivered and available for customer use

-Once our team completes the setup, the reservation location is final and cannot be relocated, modified, or transferred to another location.

-Beach Day Setup strives to have every reservation ready before the scheduled start time. If the completed setup is delayed by more than 15 minutes due solely to Beach Day Setup, the customer's exclusive remedy shall be a prorated refund based on the unused reservation time.

-If you request a specific setup location, you must be available to meet our setup team in person upon arrival. Depending on our schedule, our team may arrive several hours before your reservation start time. If you are unavailable when we arrive, we reserve the right to complete your setup at the nearest suitable location within the requested area.

Location Accessibility & Safety

All locations must have safe, direct access. Locations requiring stairs, cliffs, steep slopes, or other unsafe access may be relocated, at Beach Day Setup's sole discretion, to the nearest safe and accessible location.

6. Refund & Cancellation Policy

-Full Refund: Cancellations made at least 24 hours before the scheduled start time will receive a full refund.

-No Refunds are provided for Same Day Cancellations for any reason, including but not limited to weather, beach conditions, or setup locations.

7. Weather Policy

In the event of unsafe weather conditions (rain, high winds, beach closures), we will:

-Attempt to reschedule your event at no additional cost if cancelled 4 hours before start time.

-Final decisions regarding weather-related cancellations are at the discretion of Bonfire Pit Rentals.

8. Force Majeure

Bonfire Pit Rentals is not liable for failure to perform due to causes beyond our control, including but not limited to: natural disasters, acts of government, labor disputes, pandemics, or civil unrest.

9. Waiver of Liability

By booking our service, you agree to the following:

-You voluntarily assume all risks associated with outdoor fire activities, including but not limited to injury, property damage, or fire hazards.

-Sdchecklist LLC (DBA Bonfire Pit Rentals) shall not be held liable for any injury, loss, or damage sustained during the event, whether caused by equipment failure, environmental conditions, or participant behavior.

-You release and discharge Bonfire Pit Rentals and its employees from all claims and liabilities arising from or related to your event.

10. Communication & SMS Opt-In

By booking or submitting an inquiry, you consent to receive SMS messages and email notifications regarding:

-Reservation confirmations

-Arrival instructions

-Payment reminders

-Promotions or discounts

You may opt out at any time by replying “STOP” to any text message.
